General Terms and Conditions (GTC)

§ 1 Scope

These GTC apply to all purchase contracts, orders, and deliveries between you as the buyer and us, Cool Stuff Trading GmbH, when you shop via our online store.

Only our terms and conditions apply—unless we have expressly agreed to special individual arrangements with you. The version of the terms valid at the time of contract conclusion shall apply. Any deviating terms from the buyer are not valid.

§ 2 Offers, Prices & Contract Conclusion

To shop with us, you must be at least 18 years old and fully legally competent.

All our offers are subject to these GTC. The prices displayed in our online shop on the day of your order are binding—including VAT, but excluding shipping costs. We reserve the right to make price changes, correct errors, and adjust availability.

Product and price information in our shop is non-binding. Only when you click “Buy” after filling your shopping cart, entering your personal details, and selecting shipping and payment method, are you making a binding offer.

Our system will send you an automatic order confirmation—however, this does not constitute acceptance of the contract. The purchase contract is concluded only when we ship the goods or confirm your order via a separate email.

§ 3 Right of Withdrawal

Your Right of Withdrawal

If you're ordering as a private individual, you have a right of withdrawal. You may cancel the contract within 14 days without giving any reason.

The period begins on the day you or a designated person (excluding the delivery service) receives the goods.

If you ordered multiple items and they are delivered separately, the period begins once the last item has arrived.

Withdrawal Procedure

You may use our withdrawal form template, but it is not required. It's sufficient if you send your declaration within the 14-day period.

Consequences of Withdrawal

Once we receive your withdrawal, we will refund all payments including shipping costs within 14 days. We will use the same payment method you used unless we agree on something different.

We may withhold the refund until we receive the goods back or proof that you’ve sent them.

You must return the goods within 14 days of declaring withdrawal. Return shipping costs are your responsibility. You’re only liable for any loss in value if it’s due to improper use.

Exclusions from the Right of Withdrawal

Withdrawal is excluded for:

Custom-made products tailored to your needs.
Perishable goods or items with a short expiry date.
Sealed hygiene products (e.g., condoms, lubricants, underwear, sex toys) if the seal has been removed.
Software, audio, or video recordings where the seal has been opened.
Newspapers, journals, or magazines—unless it's a subscription.

§ 4 Payment

You can pay using the following methods:

Credit card (Visa, Mastercard, American Express)
Instant bank transfer (Sofortüberweisung)
PayPal
Prepayment (Shipping only after payment is received)

After placing your order, you'll receive a confirmation email. If your order doesn’t arrive, please contact us—we’ll check the shipping status and arrange a replacement if needed.

§ 5 Shipping

Your goods will be shipped only after full payment is received. We reserve the right to make partial deliveries if necessary. However, shipping costs are charged only once per order.

If delivery is delayed by more than four weeks, you may set us a grace period. If that also passes, you may withdraw from the contract.

We ship in neutral packaging with a discreet sender label. If you use a Packstation (parcel locker) as your address, shipping is automatically via DHL.

§ 6 Transfer of Risk

If you're a private customer, the risk of damage or loss passes to you only upon delivery.

If you're a business customer, the shipping risk passes to you once we hand over the goods to the delivery service.

§ 7 Returns, Complaints & Exchanges

Returns or exchanges are only possible within 14 days if the items are unopened, unused, and in their original packaging.

Please request a return authorization number before sending goods back.

Returns or exchanges are only processed as store credit.
Additional shipping costs may apply for re-delivery.

In case of transport damage, missing items, or incorrect deliveries, notify us within three working days by email. We will correct or replace the order. If that’s not possible, you may request a discount or cancel the purchase.

Please do not send any goods back without prior agreement!

§ 8 Data Protection

We treat your data with the utmost confidentiality and never share it with third parties.

Order data such as name, address, and payment info are necessary for processing and are stored.
Cookies are used to optimize your shopping experience. Disabling them may limit functionality.
SSL encryption protects your personal data during transmission.

§ 9 External Links

We may link to other websites. We assume no responsibility for their content.

§ 10 Online Dispute Resolution

The EU Commission offers a platform for out-of-court dispute resolution: http://ec.europa.eu/consumers/odr

§ 11 Governing Law & Jurisdiction

German law exclusively applies. Jurisdiction for all disputes is our registered office in Berlin.

§ 12 Severability Clause

If any clause of these GTC is invalid, the remaining provisions shall remain in effect.
